Synopsis

This paper focuses on intellectual property issues involved in the water industry. Obtaining patents and successfully defending them is a crucial part of a business strategy. Aspects of patent law have changed dramatically over the last 10 years, and this requires a more sophisticated interaction between the scientist/engineer and in patent lawyer. In particular, the Supreme Court decision in the Festo case makes it vital that the patent claims be very carefully drafted to avoid obtaining a very weak patent. This paper covers some reviews some patent basics, reviews new trends/decisions in patent law, and illustrates with examples from the water industry. The patent infringement case on technology for chlorine-resistant membranes will be highlighted. The goal of the paper is to provide timely information for both those in the water industry involved in technology development and those operating the business.
